Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:


Article 2 – Identity of Kaartjie


Article 3 – Applicability

  1. These terms and conditions apply to all offers, orders and agreements formed via Kaartjie's platform.
  2. By using the platform, the buyer and/or organizer accepts these terms.
  3. Deviations from these terms are only valid if agreed in writing with Kaartjie.
  4. Kaartjie reserves the right to amend these terms at any time. The amended terms take effect upon publication on the platform.

Article 4 – Role of Kaartjie

  1. Kaartjie is solely a ticketing platform that brings organizers and buyers together. Kaartjie is not a party to the agreement between the buyer and the organizer.
  2. The organizer is solely responsible for the content, execution of, and compliance with laws and regulations relating to the event.
  3. Kaartjie cannot be held liable for an event not taking place or being altered, the quality of an event, or any act or omission by the organizer.
  4. For questions about an event (time, location, programme, accessibility), the buyer should contact the organizer.

Article 5 – Registration and account

  1. Organizers must create an account to create events and sell tickets.
  2. Buyers can order tickets without an account, but must provide a valid email address.
  3. Account holders are responsible for keeping their login details confidential and for all activity under their account.
  4. Kaartjie reserves the right to block or remove accounts in the event of misuse or violation of these terms.

Article 6 – Formation of the agreement

  1. By placing an order and completing payment, an agreement is formed between the buyer and the organizer.
  2. After successful payment, the buyer receives a confirmation email with the tickets attached as a PDF.
  3. Kaartjie reserves the right to refuse or cancel orders in the event of technical errors, fraud, or exceeding capacity.

Article 7 – Prices and payment

  1. All prices on the platform are in euros and include VAT, unless stated otherwise.
  2. In addition to the ticket price, service fees may be charged. Service fees are always clearly stated in advance during the order process.
  3. Payment is made using the payment methods offered by Kaartjie (including iDEAL, Bancontact, credit card and other methods available via Mollie).
  4. The buyer is not entitled to a refund of service fees, even in the event of cancellation or refund of the ticket price. This applies both to Kaartjie's platform service fee (€ 0.80 per ticket) and to any additional service surcharge charged by the organizer per ticket. See Article 9 for the full cancellation policy.
  5. Sales proceeds are, after deduction of the € 0.80 per ticket service fee, automatically paid out to the organizer's registered IBAN account number. Payout takes place no later than 2 business days after the event ends. Until that moment, Kaartjie holds the received funds in trust on the organizer's behalf.
  6. Kaartjie reserves the right to suspend or withhold payouts in the event of reasonable suspicion of fraud, misuse, or violation of these terms. The organizer will be notified of this as soon as possible.

Article 8 – Delivery of tickets

  1. Tickets are delivered exclusively in digital form by email as a PDF attachment.
  2. Kaartjie aims to deliver tickets immediately after successful payment. In the event of technical issues, this will happen as soon as possible.
  3. The buyer is responsible for providing a correct email address. In the event of an incorrect email address, Kaartjie may ask the organizer to correct it.
  4. Tickets must be kept safe. Kaartjie is not liable for the loss, theft or unauthorized use of a ticket.

Article 9 – Cancellation and refunds

  1. The cancellation and refund policy is determined per event by the organizer and is shown on the event page during ordering.
  2. The organizer can choose:
    • No cancellation possible – tickets cannot be returned or exchanged.
    • Cancellation on request – the buyer can submit a request to the organizer; a refund is at the organizer's discretion.
    • Cancellation with full refund – the buyer receives the base ticket price back, excluding all service fees (see paragraph 4).
  3. In all cases, the buyer must request the cancellation from the event's organizer (via the contact details on the event page or in the confirmation email), not from Kaartjie. The organizer processes the cancellation and any refund themselves via the platform; Kaartjie is not a party to this request.
  4. Service fees are never refunded, regardless of the organizer's cancellation policy. This applies both to Kaartjie's platform service fee (€ 0.80 per ticket) and to any additional service surcharge the organizer charges per ticket when creating the event. In the event of a refund, the buyer therefore only receives the ticket price, excluding these service fees.
  5. In the event of cancellation or postponement of an event by the organizer, the organizer must inform buyers and offer a refund. Kaartjie facilitates the refund via the platform but is not primarily liable for this.

Article 10 – Use of tickets and access

  1. Each ticket is unique and contains a personal QR code. A ticket can only be scanned once and grants a single admission to the event.
  2. The buyer must show the ticket on a readable screen or as a printed copy at the entrance to the event.
  3. In the event of misuse, fraud, forgery or unauthorized resale, admission will be refused. Kaartjie is not liable for this.
  4. Resale of tickets above face value is not permitted.

Article 11 – Organizer's obligations

  1. The organizer guarantees that all information about the event is correct, complete and up to date.
  2. The organizer is responsible for providing a correct and valid IBAN account number in their profile, so that automatic payout can take place after the event ends. Kaartjie is not liable for delay or failure of payout resulting from an incorrectly provided account number.
  3. The organizer undertakes to hold the event as published, or to inform buyers promptly of any changes.
  4. The organizer indemnifies Kaartjie against all claims from buyers arising from the organizer's failure to meet their obligations.
  5. The organizer may only use buyers' personal data (including name and email address) for communication that is directly related to the relevant event, such as practical information, changes or cancellation. The organizer is expressly prohibited from approaching buyers for commercial purposes, newsletters, other events, or any other form of unsolicited communication. Violation of this is in breach of the GDPR and may lead to termination of the account.
  6. The organizer is responsible for compliance with all applicable laws and regulations, including permits, BUMA/STEMRA fees and safety regulations.

Article 12 – Liability

  1. Kaartjie is not liable for damage resulting from the organizer failing to hold an event, holding it late, or holding it incorrectly.
  2. Kaartjie is not liable for indirect damage, consequential damage, loss of profit or missed savings.
  3. Kaartjie's liability is in all cases limited to the amount actually received by Kaartjie in service fees in connection with the relevant order.
  4. Kaartjie is not liable for outages, technical errors or delays caused by third parties, including payment service providers and email providers.

Article 13 – Personal data and privacy

  1. Kaartjie processes personal data in accordance with the General Data Protection Regulation (GDPR).
  2. Buyers' personal data is shared with the relevant organizer insofar as necessary for the performance of the agreement.

Article 14 – Intellectual property

  1. All intellectual property rights to the platform, including the source code, design, texts and logos, belong to Kaartjie.
  2. It is not permitted to copy, distribute or use content from the platform without Kaartjie's prior written consent.

Article 15 – Complaints and disputes

  1. Complaints about an event should first be submitted to the organizer.
  2. Complaints about the functioning of the platform can be submitted via hallo@kaartjie.nl.
  3. Kaartjie will respond to complaints on the merits as soon as possible, but no later than within 14 days.
  4. If a complaint is not resolved satisfactorily, the buyer may submit the dispute to the competent court.

Article 16 – Amendments

  1. Kaartjie reserves the right to amend these terms and conditions.
  2. Amendments take effect 14 days after publication on the platform, unless another date is stated.
  3. For ongoing agreements, the terms that applied at the time the agreement was formed remain in effect.

Article 17 – Governing law

  1. Dutch law exclusively applies to all agreements and disputes.
  2. Disputes will be submitted to the competent court in the district of Noord-Nederland, unless mandatory law prescribes a different court.
